Rental AgreementsAs per Article 7.2 of the Fountain View Declaration of Covenants, Conditions, and Restrictions, all rentals must be for a period of no less than three (3) consecutive months, but no more than twelve (12) consecutive months in a rental year. A rental year shall be defined as any twelve (12) month period starting with the first day of the rental agreement. No Dwelling shall be occupied by more than two (2) persons for each bedroom. The den shall not be considered a bedroom. • Background and Criminal Check – The owner, or the owner’s rental agent shall, at the owner’s expense, conduct a background and criminal check on all proposed tenants. A copy of the background and criminal check shall be submitted to the Association with the completed application to Keys-Caldwell, Inc. thirty (30) days prior to the first day of the proposed rental. Any negative background check may serve as sufficient reason for the Board of Directors to deny an application.  • Processing Fees – The proposed tenant(s) shall pay a non-refundable application fee of $50.00 payable to Fountain View Villas Master Association in an amount to set forth in the Rules and Regulations, as amended from time to time, and must be submitted by the tenant or owner to Keys-Caldwelol, Inc. thirty (30) days prior to the rental start date. Contact Keys-Caldwell, Inc. for current fee (also listed in January Board Minutes). NOTE: Rental application fees are not charged to seasonal or annual tenants who are renewing to the same unit each year.  • If the seller and the buyer made other arrangements to pay this application fee, please work it out between yourselves to see that this fee is paid within 72 hours or the application will be denied.  • Tenant Rights – It is understood that the tenant of this house assumes all of the rights and responsibilities, except voting, of living in Fountain View Villas Master Association as enumerated in the Declaration of Covenants Conditions and Restrictions, and the Architectural Control Committee Rules and Guidelines. It is also understood that it is the responsibility of the homeowner to provide these regulations to the tenant, which can be found in the Fountain View Homeowner’s Handbook. Adopted by board of Directors 1/29/2009 Revised and Board Approved 07 1 20 1 2015.  • Homeowners’ Rights – By endorsing this agreement, the owner understands and agrees that for the duration of the rental period all rights to use any common area facilities are relinquished, and that the tenant will be granted full access to all common area facilities. It is also the responsibility of the homeowner to provide, in addition to their house key, all necessary keys for the clubhouse and the mailbox.  • Damage to Common Areas – The homeowner also agrees to make financial restitution to the Fountain View Villas Master Association in the event that the tenant damages any common area facilities or grounds and refuses to pay for repairs.  • Pool and Clubhouse – The tenant agrees to abide by all rules and regulations regarding the use of the pool and the clubhouse.  • Termination of Agreement – The tenant understands and agrees that the Board of Directors can terminate this lease agreement at any time if the tenant violates any of the rules and conditions of this association.  • Confidentiality – All information listed on this form, and any subsequent information obtained during interviews shall remain strictly confidential.
